General Terms and Conditions of Sale – Sugarboard

These General Terms and Conditions of Sale ("GTCS") govern sales of products made on the Sugarboard website between:

Any natural person making a purchase for personal, non-professional purposes (the "Customer").

Any order implies full and complete acceptance of these GTCS.

ARTICLE 1 — PURPOSE

These GTCS define the conditions applicable to the sale of Sugarboard products via the online store.

The products marketed are electronic devices for the secondary display of glycemic data from compatible third-party services.

ARTICLE 2 — PRODUCT DESCRIPTION

Sugarboard is an electronic device based on a microcontroller equipped with an LED matrix allowing the secondary display of CGM data.

The product may be compatible with certain third-party CGM-type services and community platforms.

The list of compatible services is provided for indicative purposes, is non-exhaustive, and is subject to change at any time according to technical, contractual, or regulatory modifications made by the relevant third-party providers.

ARTICLE 3 — MEDICAL DISCLAIMER

Sugarboard is not a certified medical device.

The product:

  • does not replace an official medical device;
  • does not allow the diagnosis, treatment, or prevention of any illness;
  • constitutes solely a secondary display and convenience device.

The source CGM sensor and its official application remain the only sources of medical reference.

No medical, therapeutic, or emergency decision should be made solely on the basis of the information displayed by Sugarboard.

In case of doubt, alert, or medical situation, the user must always verify the data via the official medical device and consult a healthcare professional.

ARTICLE 4 — AVAILABILITY OF THIRD-PARTY SERVICES

The operation of the product partially depends on third-party services, infrastructures, APIs, and platforms independent of Sugarboard.

We do not guarantee:

  • the continuous availability of third-party services;
  • the permanent maintenance of integrations;
  • the absence of technical changes imposed by third-party providers.

Any interruption, restriction, technical modification, or removal of a compatible third-party service may temporarily or permanently prevent certain features of the product from operating.

ARTICLE 5 — PRICES

Prices displayed on the site are expressed in euros (€) inclusive of all taxes, unless otherwise indicated.

Shipping fees are specified before order validation.

Sugarboard reserves the right to modify its prices at any time. Products are billed based on the rate in effect at the time of the order.

ARTICLE 6 — ORDERS

Any order placed on the site constitutes a purchase offer.

The seller reserves the right to refuse or cancel any order, in particular in case of:

  • suspected fraud;
  • obvious pricing errors;
  • product unavailability;
  • previous dispute with the Customer.

The order is considered accepted after shipping confirmation.

ARTICLE 7 — PAYMENT

Payment is made via the payment methods offered on the site at the time of the order.

Transactions are secured via Shopify's partner payment providers.

The Customer warrants that they are authorized to use the payment method provided.

ARTICLE 8 — DELIVERY

The products are delivered to the address indicated at the time of the order.

Delivery times are provided as an indication.

The seller cannot be held responsible for delays attributable to:

  • carriers;
  • customs services;
  • logistical disruptions;
  • cases of force majeure;
  • or any event beyond its control.

The transfer of risks occurs at the time the product is received by the Customer.

ARTICLE 9 — RIGHT OF WITHDRAWAL

In accordance with Articles L221-18 et seq. of the French Consumer Code, the Customer has a period of fourteen (14) days from receipt of the product to exercise their right of withdrawal without having to justify a reason.

To exercise this right, the Customer must contact Sugarboard at the following address: contact@mysugarboard.com

The product must be returned:

  • in its original condition;
  • complete;
  • with any accessories;
  • in packaging allowing its resale.

Return costs remain the responsibility of the Customer unless otherwise required by law.

The refund will be made within a maximum period of fourteen (14) days after receipt and verification of the returned product.

ARTICLE 10 — LEGAL GUARANTEE OF CONFORMITY

The consumer benefits from the legal guarantee of conformity provided for in Articles L217-3 et seq. of the French Consumer Code, as well as the legal guarantee against hidden defects provided for in Articles 1641 et seq. of the French Civil Code.

The consumer:

  • has a period of two years from the delivery of the goods to take action;
  • may obtain the repair or replacement of the product;
  • may obtain a reduction in the price or a refund under the conditions provided for by law.

These guarantees apply independently of any commercial warranty.

ARTICLE 11 — LIMITATION OF LIABILITY

Within the limits permitted by applicable law, Sugarboard cannot be held responsible for:

  • interruptions of third-party services;
  • errors or unavailability of external APIs;
  • data losses;
  • indirect damages;
  • financial or commercial losses;
  • medical decisions made by the user.

The user acknowledges that:

  • the data displayed may include delays;
  • the product depends on independent third-party infrastructures;
  • the product does not replace an official medical device.

No provision of these GTCS limits the mandatory legal rights of the consumer provided for by French and European law.

ARTICLE 12 — PERSONAL DATA

Personal data collected as part of orders is processed in accordance with our Privacy Policy.

ARTICLE 13 — WEEE

In accordance with the regulations relating to Waste Electrical and Electronic Equipment (WEEE), electronic products must not be disposed of with household waste.

The Customer is invited to deposit used equipment at appropriate collection points.

ARTICLE 14 — FORCE MAJEURE

The seller's liability cannot be engaged in the event of non-performance or delay resulting from a force majeure event within the meaning of French law.

ARTICLE 15 — APPLICABLE LAW

These GTCS are governed by French law.

In the event of a dispute, French courts shall have jurisdiction, subject to mandatory provisions applicable to consumers.

The consumer may also have free recourse to a consumer mediator in accordance with the provisions of the French Consumer Code.
